Auto-renewing subscriptions — please read first
This Service may include subscriptions that automatically renew. Before starting a free trial or purchasing an auto-renewing subscription service, please carefully read these Terms of Use. To avoid charges, you must affirmatively cancel a subscription or free trial in your app store's account settings at least 24 hours before the end of the free trial or current subscription period.
If you're unsure how to cancel, please visit Apple Support, Google Play Help, or the support pages of other app stores. Deleting the app itself does not cancel your subscriptions or free trials. We recommend taking a screenshot of this information for your future reference.
Acceptance of terms
ABC Cleaner (the "App") is a mobile application designed to locate and delete duplicate photos, screenshots, videos, and contacts from your device. The content accessible through the App (the "Content") is provided by TAPRISE LTD ("we", "us", "our", or the "Company"). The App, along with its Content, tools, transactions, and other services available through the App, collectively constitute the "Service".
By accessing and using the Service, you agree to be bound by these Terms of Use (the "Terms"), establishing a legally binding contract between you and the Company. Please read the Terms carefully before using the Service.
Additionally, please review our Privacy Policy. The terms of the Privacy Policy and any other supplementary terms, policies, or documents posted on the Service from time to time are expressly incorporated into these Terms by reference. We reserve the right, at our sole discretion, to modify or amend these Terms at any time and for any reason.
Unless expressly provided otherwise herein, we will notify you of any changes by updating the "Last updated" date of these Terms, and you waive any right to receive specific notice of each such change.
If you do not agree with any part of these Terms, or if you are not eligible or authorised to be bound by these Terms, then do not download the App or otherwise access or use the Service.
Use of service & age restrictions
You acknowledge and accept that your use of the Service is entirely at your own risk and responsibility, and you are solely accountable for all actions performed using the Service. We bear no liability for any actions taken by you while using the Service.
The Service may be modified, updated, interrupted, or suspended at any time without prior notice or liability to you.
The Service is not intended for distribution to, or use by, any person or entity in any jurisdiction or country where such distribution or use would contravene any law or regulation, or subject us to any registration requirement within that jurisdiction or country. Users who access the Service from locations outside its intended jurisdictions do so voluntarily and are solely responsible for complying with local laws.
The Service is designed for users who are at least 16 years old. Minors must obtain the consent of and be supervised by their parent or guardian to use the Service. If you are a minor, your parent or guardian must read and agree to these Terms before you can use the Service.
Intellectual property rights & license
The Service, unless stated otherwise, is our exclusive property. This includes all source code, databases, functionality, software, designs, audio, video, text, photographs, and graphics on the Service (collectively, the "Content"), as well as the trademarks, service marks, and logos contained therein (the "Marks").
Unless expressly permitted in these Terms, no part of the Service, Content, or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose without our prior written consent.
Subject to your eligibility to use the Service, we grant you a limited, non-exclusive, non-transferable, revocable right to install and use the Service on wireless electronic devices that you own or control, and to access and use the Service strictly in accordance with these Terms.
User representations
By using the Service, you represent and warrant that:
- You have the legal capacity and agree to comply with these Terms.
- You are at least 16 years old.
- If you are a minor in your jurisdiction, you have obtained parental permission to use the Service.
- You will not access the Service using automated or non-human means, such as bots or scripts.
- You will not use the Service for any illegal or unauthorised purpose.
- Your use of the Service will not violate any applicable laws or regulations.
If any information you provide is found to be untrue, inaccurate, outdated, or incomplete, we reserve the right to refuse any current or future use of the Service.
Prohibited activities
You agree not to use the Service for any purpose other than intended. Specifically, you must not:
- Systematically gather data or content without permission.
- Engage in unauthorised use, modification, or derivative works of the Service.
- Use the Service for revenue-generating purposes not intended by its design.
- Share access to the Service in a networked environment.
- Develop products or software that compete with the Service.
- Use proprietary information or interfaces for unauthorised applications.
- Attempt to bypass security features or interfere with the Service's functionality.
- Frame or link to the Service without authorisation.
- Disrupt the Service or its connected networks.
- Reverse engineer, decode, or otherwise tamper with the Service's software.
- Upload viruses or harmful software.
- Use automated systems to access the Service without permission.
- Use the Service for unsolicited commercial email.
- Exploit children or produce content harming the Service's reputation.
- Violate any applicable laws or these Terms.
Subscriptions, billing & refunds
The Service offers basic functions for free, supported by ads. You can opt for ad-free premium features through in-app purchases, which renew automatically unless cancelled at least 24 hours before the trial ends. Subscription purchases are handled by the App Store, subject to its policies.
Free trial. A free trial of the premium features may be offered to new users. After the trial ends, you will be charged automatically for the chosen subscription period unless you cancel before the trial expires.
Subscription periods. Subscriptions are typically offered on a weekly, monthly, or yearly basis. The exact prices and billing cycles are displayed in the App at the time of purchase and may vary by region.
Auto-renewal. All subscriptions automatically renew at the end of each billing cycle at the standard rate, unless cancelled at least 24 hours before the renewal date. Renewal is processed by the App Store using your registered payment method.
Cancellation. You can cancel your subscription at any time through your App Store account settings (Settings → [Your Name] → Subscriptions on iOS). Cancelling stops future charges; access to premium features remains until the end of the current billing period.
Refunds. Refunds are managed by the App Store according to its policies. To request a refund, contact Apple Support directly. Deleting the App does not cancel your subscription.
User content
You are responsible for any content you create or upload ("User Content") and must ensure it complies with these Terms. By sharing User Content, you grant us a global, royalty-free license to use it as described in this agreement.
Third-party content
We may link to third-party resources or content, but we aren't responsible for their accuracy, appropriateness, or privacy practices. Your interactions with third parties through the Service are solely your responsibility.
User data
We prioritise data privacy and security. By using the Service, you agree to our Privacy Policy, which is part of these Terms.
Term & termination
These Terms apply as long as you use the Service. We can deny or terminate access at our discretion, without notice, for any reason, including breaches of these Terms or legal requirements.
Modifications & interruptions
We may modify, suspend, or discontinue the Service at any time without notice or liability. We aren't responsible for any loss or inconvenience due to Service downtime.
Governing law
These Terms are governed by the laws of England and Wales, excluding conflict of law principles. Disputes will be resolved in specified courts based on your location.
Mandatory binding arbitration & class action waiver
Disputes must be resolved through binding arbitration, waiving the right to a jury trial or class action. This provision excludes certain claims related to intellectual property.
Corrections
We may correct errors or update information on the Service without prior notice.
Disclaimer of warranties
The Service is provided "as is." We disclaim all warranties regarding its use, content accuracy, and any damages arising from its use.
Limitation of liability
We limit our liability to the amount paid by you or $100, whichever is less, for any claims arising from your use of the Service.
Indemnification
You agree to indemnify us against any claims arising from your use of the Service or breach of these Terms.
Electronic communications, transactions, and signatures
You agree to receive electronic communications and consent to electronic signatures for transactions and notices related to the Service.
Miscellaneous
These Terms constitute the entire agreement between you and us. We may assign our rights without notice. If any provision is deemed unlawful, it doesn't affect the validity of the remaining terms.
